Repeat applications
Within 28 days of a refusal, you must show a material change in circumstances.
Removal date
If removal is set within 21 days, the tribunal can usually only grant bail with Home Office consent.

Immigration Bail: your questions

Still unsure? A ten-minute call usually settles it.

How quickly can a bail hearing happen?

Hearings are usually listed within a few working days of the application.

Do we need someone to pay money?

Not always. A financial condition is only imposed where it helps ensure the person keeps to their bail conditions.

Can we ask the Home Office instead?

Yes. You can ask the Home Office for bail as well as, or before, applying to the tribunal.

Is there automatic review of detention?

In many cases the Home Office must refer a person to the tribunal for a bail hearing once they have been detained for 4 months. Exceptions apply, including deportation cases.
