Judicial Review (JR) is the process whereby judges of the High Court & Upper Tribunal assess the lawfulness of actions of public bodies such as the Home Office. It is possible to challenge immigration decisions made by the Home Office by way of Judicial Review.

Judicial Review is a mechanism used as a last resort. Prior to commencing JR, all other alternative dispute resolution options have to be considered.

If the PAP does not lead to a positive outcome, we will advise you on the merits of your particular issue based on the laws and policy at the time of the decision. A successful Judicial Review often results in costs being awarded to the applicant. However, an unsuccessful Judicial Review can lead to the applicant paying costs to the Home Office. We would usually not advise our clients to proceed with Judicial Review if we consider that they have a poor chance of success.

Time is of the essence in these circumstances as any challenge must be made within 3 months of the negative immigration decision being given.
